1. Agreement to These Terms

These Terms of Service ("Terms") are a binding agreement between you ("you," "your," or "Customer") and OK Military Search ("OK Military Search," "we," "us," or "our"), operated in connection with Smoking Gun Investigations, LLC, a licensed private investigation firm. By accessing okmilitarysearch.com, submitting a request, or paying for our service, you agree to these Terms, our Privacy Policy, our Refund Policy, and our Disclaimer. If you do not agree, do not use the website or the service.

If you are using the service on behalf of a business, law firm, or other organization, you represent that you have authority to bind that entity to these Terms.

2. Description of the Service

Many people must file a Military Service Affidavit (also called an Affidavit of Non-Military Service) before a court will enter a default judgment, but they lack the defendant's date of birth (DOB) or Social Security number (SSN) needed to run the official Department of Defense (DoD) active-duty status check. OK Military Search solves that problem.

A licensed private investigator (Smoking Gun Investigations, LLC, smokinggunpi.com) uses professional skip-trace tools to locate the missing SSN and/or DOB, then runs the search through the official DoD Defense Manpower Data Center (DMDC) SCRA system to obtain the active-duty status certificate, which is emailed to you.

The flow is simple: you submit a request form, you pay the fee, our licensed investigator locates the DOB/SSN and runs the DoD check, and the certificate is emailed to you. Learn more on our How It Works page and read about the underlying law on our SCRA information page.

3. Not a Consumer Reporting Agency; FCRA Limitations

OK Military Search is not a consumer reporting agency. The military active-duty status verification we provide is not a "consumer report" or "investigative consumer report" under the federal Fair Credit Reporting Act (FCRA), 15 U.S.C. § 1681 et seq.

You agree that you will not use the certificate or any information we provide, in whole or in part:

  • as a factor in establishing eligibility for credit or insurance;
  • for employment purposes, including hiring, retention, promotion, or reassignment;
  • for tenant or housing screening or any rental decision;
  • for any other FCRA "permissible purpose"; or
  • in any manner that would cause the service to be considered a consumer report.

Our service is intended for purposes such as litigation, service of process, and compliance with the Servicemembers Civil Relief Act (SCRA). It is not a background check.

4. Permissible Purpose and Lawful-Use Representation

Location of an individual's SSN or DOB is performed by a licensed private investigator only for permissible purposes, consistent with the Gramm-Leach-Bliley Act (GLBA), the Driver's Privacy Protection Act (DPPA), and other applicable law. By placing an order, you represent and warrant that:

  • you have a permissible purpose for requesting the search (for example, use in connection with litigation, service of process, or SCRA compliance);
  • you will use the results only for that lawful purpose and in compliance with all applicable federal, state, and local laws;
  • you are not requesting the search for stalking, harassment, fraud, or any unlawful or prohibited purpose;
  • the information you provide to us about yourself and the individual being searched is accurate and submitted in good faith; and
  • you will not use the service for any FCRA permissible purpose as described in Section 3.

We may decline or cancel any request that we believe lacks a permissible purpose or that may violate these Terms or applicable law.

5. No Government Affiliation; Free DoD Report Available

OK Military Search is a private service and is not affiliated with, endorsed by, or acting on behalf of the U.S. Department of Defense (DoD), the Defense Manpower Data Center (DMDC), or any government agency.

The DoD's active-duty status report is available directly from the government for free at scra.dmdc.osd.mil — but only if you already have the individual's SSN or DOB. When you order from us, you are paying for the professional locating/skip-trace service, the licensed investigative work needed to find the missing SSN/DOB, and the convenience of having it all done for you. You are not paying for the government record itself.

6. Not Legal Advice; No Attorney-Client Relationship

OK Military Search is not a law firm and does not provide legal advice. Nothing on this website or in any communication with us creates an attorney-client relationship. All content, including pages such as SCRA information and Military Service Affidavit, is general information only and may not apply to your specific situation. For legal questions — including whether you have a permissible purpose, whether an affidavit is required, or how to use a certificate in court — consult a licensed attorney in the relevant jurisdiction.

7. Accuracy Disclaimer and DoD Data Limitations

The active-duty status certificate is generated from data maintained by the DoD/DMDC. We do not control, create, or guarantee that data. You acknowledge the following limitations:

  • The DMDC active-duty database reflects active-duty service from September 30, 1985 to the present, plus certain early-notification (call-up) statuses.
  • The certificate establishes active-duty status on the queried date. It does not, by itself, resolve every SCRA-eligibility nuance.
  • Accuracy depends on correct identification of the individual. If the SSN/DOB located corresponds to a different person, or if government records are incomplete, the result may not reflect the intended individual.

We make no representation that a certificate will be accepted by any particular court or that it will satisfy the requirements of any particular case. You are responsible for confirming that the certificate meets your court's requirements.

8. Fees and Payment

$22 per defendant

One flat fee for each defendant you list.

The fee for the service is $22 per defendant. Payment is collected when you place your order through our order form. See our pricing page for details. You are responsible for any taxes that may apply. You authorize us to charge the payment method you provide for the fee associated with your request.

9. Refund Policy

We operate on a "no result, no charge" basis. If we are unable to provide an active-duty status certificate for your case, your $22 fee is fully refunded. For complete details, including how and when refunds are issued, see our Refund Policy.

10. User Responsibilities and Acceptable Use

You agree that you will:

  • provide accurate, complete information and a valid permissible purpose;
  • use the website and service only for lawful purposes and in compliance with these Terms;
  • not resell, redistribute, or commercially exploit certificates or results except as permitted by law and consistent with your stated permissible purpose;
  • not attempt to gain unauthorized access to, interfere with, or disrupt the website, our systems, or other users; and
  • not use the service to violate the privacy or rights of any person, or for any harassing, abusive, fraudulent, or unlawful activity.

You are solely responsible for how you use any information we provide, including any filings you make with a court.

11. Intellectual Property

The website, including its text, design, graphics, logos, and other content (excluding government records and your own submitted data), is owned by OK Military Search or its licensors and is protected by applicable intellectual property laws. You may not copy, reproduce, modify, distribute, or create derivative works from the website without our prior written permission, except for your own internal, lawful use of certificates we deliver to you.

12. Disclaimer of Warranties

The website and service are provided "as is" and "as available" without warranties of any kind, whether express or implied. To the fullest extent permitted by law, we disclaim all implied warranties, including warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that the service will be uninterrupted, error-free, or that any particular result, certificate, or court acceptance will be achieved. Some jurisdictions do not allow certain warranty exclusions, so some of these exclusions may not apply to you.

13. Limitation of Liability

To the fullest extent permitted by law, OK Military Search and Smoking Gun Investigations, LLC, and their owners, members, employees, and agents, will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any lost profits, lost data, or loss of goodwill, arising out of or related to your use of (or inability to use) the website or service, even if advised of the possibility of such damages.

To the fullest extent permitted by law, our total aggregate liability arising out of or related to the service or these Terms will not exceed the amount you paid to us for the order giving rise to the claim. Some jurisdictions do not allow certain limitations of liability, so some of these limitations may not apply to you.

14. Indemnification

You agree to indemnify, defend, and hold harmless OK Military Search and Smoking Gun Investigations, LLC, and their owners, members, employees, and agents, from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your use or misuse of the website or service; (b) your breach of these Terms; (c) your lack of a permissible purpose or your violation of the FCRA, GLBA, DPPA, SCRA, or any other applicable law; or (d) your use of any certificate or information we provide.

15. Privacy and Data Security

We collect SSNs and other personal information solely to perform the requested search, and we collect and handle that information securely. We use it only to provide the service and do not use it for any incompatible purpose. For full details on what we collect, how we use it, how we protect it, and your choices, please review our Privacy Policy.

16. Governing Law

Although we serve customers nationwide, these Terms are governed by and construed in accordance with the laws of the State of Oklahoma, without regard to its conflict-of-laws principles. This choice of law does not limit any non-waivable consumer protections available to you under the laws of your home state. You agree that any dispute will be subject to the applicable courts having jurisdiction, except where prohibited by law.

17. Changes to These Terms

We may update these Terms from time to time. When we do, we will revise the effective date at the top of this page. Material changes will be posted here, and your continued use of the website or service after changes take effect constitutes acceptance of the revised Terms. We encourage you to review this page periodically.
